Privacy Notice Regarding the Processing of Personal Data of Individuals Participating in the Recruitment Process at Cloudflight Poland sp. z o.o.

1. The controller of your personal data is Cloudflight Poland, a limited liability company with its registered office in Wrocław, at ul. Legnicka 16, 53-673 Wrocław. You may contact Cloudflight Poland regarding the protection of personal data via email at rodo@cloudflight.io or in writing at the address indicated above.

2. Your personal data will be processed: 

a. if you prefer employment under an employment contract – the data will be processed pursuant to Article 6(1)(c) of the GDPR, i.e., to fulfill legal obligations related to the recruitment process, including, above all, Article 22(1) of the Labor Code. To conduct the recruitment process with regard to data not required by law—the legal basis for processing is consent (Article 6(1)(a) of the GDPR, and with regard to special categories of data, such as health status – Article 9(2)(a) of the GDPR);

b. if you prefer employment under a civil law contract, the legal basis for processing the data contained in your application documents is the intention to enter into a contract with Cloudflight Poland (Article 6(1)(b) of the GDPR) and your consent (Article 6(1)(a) of the GDPR, and with regard to special categories of data, such as health status – Article 9(2)(a) of the GDPR);

c. pursuant to Article 6(1)(f) of the GDPR – for the purpose of establishing, exercising, or defending against legal claims by Cloudflight Poland.

3. Your application cannot be processed if you do not provide the required information (see points a and b below). Providing the remaining information contained in the submitted documents (e.g., photos, interests, health information) is voluntary and does not affect the consideration of your application:

a. if you are interested in employment under an employment contract – we need the information specified in the Labor Code, i.e., first and last name, contact information, education, professional qualifications, and employment history;

b. if you are interested in employment under a civil law contract – we need the data necessary to evaluate your application, i.e., first and last name, contact information, and information about your professional experience and/or education as provided in the submitted documents.

4. Your personal data will be shared with the following entities: hosting service providers, email service providers, a law firm, the provider of the recruitment tool (Personio GmbH), and entities affiliated with Cloudflight Poland (Cloudflight GmbH, Sappho zweiundzwanzigste Holding GmbH, Cloudflight Austria GmbH, Cloudflight Romania Srl, Cloudflight Germany GmbH).

5. Your data will be stored for the time necessary to complete the recruitment process and for us to select a candidate or candidates, that is, until you are hired under an employment contract or until a civil law contract is signed. If you additionally consent to participate in future recruitment processes, we will store your data for one year from the date you submit your application.

6. You have the right to access your personal data, to have it corrected, deleted, or its processing restricted, to object to its processing, and the right to data portability. If the basis for processing personal data is consent, you have the right to withdraw it at any time, which does not affect the lawfulness of the processing carried out prior to its withdrawal.

8. You have the right to file a complaint with the President of the Personal Data Protection Office if you believe that your personal data is being processed unlawfully.

9. All matters regarding the protection of your personal data in connection with your participation in the recruitment process are described in this clause. For other matters not related to recruitment, our Privacy Policy applies.



Klauzula informacyjna o przetwarzaniu danych osobowych osób biorących udział wrekrutacji Cloudflight Poland sp. z o.o.

1. Administratorem Twoich danych osobowych jest Cloudflight Poland spółka z ograniczoną odpowiedzialnością z siedzibą we Wrocławiu, ul. Legnicka 16, 53-673 Wrocław. Kontakt z Cloudflight Poland w sprawie ochrony danych osobowych jest możliwy pod adresem e- mail: rodo@cloudflight.io. lub pisemnie na adres wskazany powyżej.

2. Twoje dane osobowe będą przetwarzane:

a. w sytuacji preferowania przez Ciebie zatrudnienia na podstawie umowy o pracę – dane będą przetwarzane na podstawie art. 6 ust. 1 lit. c RODO tj. w celu wykonania obowiązków wynikających z przepisów prawa, związanych z procesem rekrutacji, w tym przede wszystkim art. 22(1) Kodeksu Pracy. W celu przeprowadzenia procesu rekrutacji w zakresie danych niewymaganych przepisami prawa – podstawą prawną przetwarzania jest zgoda (art. 6 ust. 1 lit. a RODO, a w zakresie danych dotyczących danych szczególnych jak np. stan zdrowia – art. 9 ust. 2 lit a RODO);

b. w sytuacji preferowania przez Ciebie zatrudnienia na podstawie umowy cywilnoprawnej podstawą prawną przetwarzania danych zawartych w dokumentach aplikacyjnych jest chęć zawarcia umowy z Cloudflight Poland (art. 6 ust. 1 lit. b RODO) oraz Twoja zgoda (art. 6 ust. 1 lit. a RODO, a w zakresie danych dotyczących danych szczególnych jak np. stan zdrowia – art. 9 ust. 2 lit a RODO);

c. na podstawie art. 6 ust. 1 lit. f RODO – w celu ustalenia, dochodzenia lub obrony przed roszczeniami przez Cloudflight Poland.

3. Zgłoszenie rekrutacyjne nie będzie mogło zostać rozpatrzone w przypadku niepodania wymaganych danych (zob. lit a i b poniżej). Podanie pozostałych danych zawartych w przesłanych dokumentach (np. zdjęcia, zainteresowań, informacji o stanie zdrowia) jest dobrowolne i nie wpływa na rozpatrzenie kandydatury:

a. jeśli jesteś zainteresowany zatrudnieniem na umowę o pracę – potrzebujemy danych wskazanych w Kodeksie pracy, tj. imienia i nazwiska, danych kontaktowych, wykształcenia, kwalifikacji zawodowych oraz przebiegu dotychczasowego zatrudnienia;

b. jeśli interesuje Cię zatrudnienie na podstawie umowy cywilnoprawnej – potrzebujemy danych niezbędnych do oceny zgłoszenia, tj. imienia i nazwiska, danych kontaktowych oraz informacji o doświadczeniu zawodowym i/lub wykształceniu podanych w przesłanych dokumentach.

4. Twoje dane osobowe będą udostępniane następującym podmiotom: dostawcy usług hostingowych, dostawcy poczty elektronicznej, kancelaria prawna, dostawcy narzędzia przy pomocy którego prowadzona jest rekrutacja (Personio GmbH) oraz podmiotom powiązanym z Cloudflight Poland (Cloudflight GmbH, Sappho zweiundzwanzigste Holding GmbH, Cloudflight Austria GmbH, Cloudflight Romania Srl, Cloudflight Germany GmbH).

5. Twoje dane będą przechowywane w czasie niezbędnym do zakończenia procesu rekrutacji i dokonania przez nas wyboru kandydata lub kandydatów, czyli po zatrudnieniu na umowę o pracę lub do podpisania umowy cywilnoprawnej. Jeśli wyrazisz dodatkowo zgodę na udział w przyszłych rekrutacjach, to będziemy przechowywać Twoje dane przez rok od przesłania przez Ciebie zgłoszenia.

6. Przysługuje Ci prawo dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania, wniesienia sprzeciwu wobec przetwarzania, a także prawo do przenoszenia danych. Jeżeli podstawą przetwarzania danych osobowych jest zgoda – prawo do jej cofnięcia w każdym czasie, co nie wpływa na legalność przetwarzania dokonanego przez jej wycofaniem.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. The use of cookies is absolutely necessary for providing our services and thus for the performance of the contract (article 6 (1) b) of the GDPR). Rights of data subjects

If Personio SE & Co. KG as the controller processes personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. To assert your rights as a data subject in relation to the data processed for the purpose of operating this recruitment website, please refer to Personio SE & Co. KG’s Data Protection Officer (see item B).

Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
